IILCC Study Group on ISDS Reform

The IILCC Study Group on ISDS Reform is a collaboration of young researchers associated to the IILCC doctoral network . The aim of the Group is to constructively contribute to the ongoing discussions on a reform of Investor-State Dispute Settlement.

To this end, the Group published a Report on the Creation and Implementation of a Multilateral Investment Court. The Report provides an overview on essential questions related to the creation and implementation of a MIC and refelcts the agenda of the 38^th session of UNCITRAL Working Group III in January 2020.

In its activities the Study Group is supported by Jun.-Prof. Dr. Julian Scheu. Its members are:

• Johanna Braun
  studied law at Humboldt University Berlin and the University of Padua. She is a doctoral candidate in international investment law at the University of Cologne and a research assistant with a Berlin law firm specialised in regulatory and competition law.
   
• Alexander Dünkelsbühler (Coordinator)
  studied law in Beijing, Mainz (First State Examination) and Panthéon-Sorbonne University in Paris (Master's degree in international economic law). He is a doctoral candidate in international investment law at the University of Cologne and currently a visiting researcher at Georgetown University Law Center.
   
• Leonard Funk
  studied laws in Cologne (Universität zu Köln) and London (UCL). He is a doctoral candidate at University of Cologne.
   
• Niclas Landmann
  studied German law at Frankfurt University, Germany and Investment Treaty Arbitration at Uppsala University, Sweden. Currently, he is a doctoral candidate at Cologne University and works with Freshfields Bruckhaus Deringer in the International Arbitration Team in the Frankfurt Office as research assistant.
   
• Samuel Meyer-Oldenburg
  studied German and European Law at Mainz (First State Examination, LL.M) and Dijon (Master´s degree in International Private Law and European Uniform Law). Currently he is a doctoral candidate at the University of Mainz.
   
• Carla Müller
  studied law in Cologne and Paris (First State Examination, LL.B (Köln/Paris I)). Currently, she is a doctoral candidate at Cologne University and works as research assistant in the dispute resolution practice in the Frankfurt Office of Linklaters.
   
• Philipp Reinhold
  studied law in Bonn, Germany and Lausanne, Switzerland. He is a doctoral candidate at Saarland University and works as a Research Assistant  at the Chair of Public International Law and European Law (Prof. Dr. Bungenberg).

The book builds on the activities of the research group and links to current discussions within the UNCITRAL Working Group III. Each chapter highlights a key element of the MIC proposal, addresses the legal issues under discussion, and places them in a broader context. Publication: "Reform of Investor-State Dispute Settlement - Current State of Play at UNCITRAL", 25 Zeitschrift für Europarechtliche Studien (ZEuS) 1/2022, 15-74. Together with the Europa-Institut of Saarland University, the IILCC examines current developments on the reform of investment arbitration. In the Zeitschrift für Europarechtliche Studien (ZEuS), the research group of both institutes provides a general overview of the central discussion points of the UNCITRAL reform process. On Tuesday, 21 January 2020, a panel discussion will take place in Vienna in cooperation with zeiler.partners on the reform of the ISDS and the creation of a Multilateral Investment Court (MIC). Participation in the event is free of charge. Further information on registration are available here.

Here you can find a report of the IILCC Study Group on ISDS Reform. The reason for this report is the Workshop on ISDS Reform and the Creation of a Multilateral Investment Court, which took place in Vienna from 19. – 24. January 2020.

On 1 October 2019, the Europa-Institut at Saarland University and the IILCC co-organised a workshop on the reform of ISDS and the creation of a Multilateral Investment Court (MIC) in Saarbrücken. The topics included were the institutional structure and the implementation of the MIC, the selection and status of the MIC judges and the recognition and enforcement of MIC decisions.
